Trial date set in capital murder case

A West Point woman will face trial in September on a capital murder charge.
The trial date for Brittania Smith, of 904 Hillside Park in West Point, was set at a bond hearing Wednesday at the Clay County Courthouse.
Smith, 24, was arrested on April 9 in connection with the December death of her 2-month-old son, Brinston Smith. According to the Mississippi Crime Lab, Brinston Smith allegedly died from a lethal dose of codeine and his death was ruled a homicide.
Clay County Sheriff Eddie Scott said emergency responders were dispatched to the residence on Dec. 20 in response to a 911 call of “a child not breathing.” According to Scott, medical personnel took the infant to North Mississippi Medical Center in West Point, where he died later that day.
Smith was charged with capital murder and has been held at the Clay County Detention Center since her arrest. She appeared before Judge Lee Howard in Clay County Circuit Court Wednesday morning for a bond hearing.
“The defense was going to try and get her a bond, but it turns out she’s already on probation for forgery charges through the Mississippi Department of Corrections,” Scott said. “She had a revocation hearing set for July 16 under Judge Jim Kitchens, and Judge Howard wouldn’t hear the motion for bond until that matter is settled in front of Judge Kitchens in two weeks.”
