Judge Finds "Open Carry" Bill Unconstitutional

July 12, 2013

Hinds County Judge Winston L. Kidd ruled Friday that House Bill 2, which deals with openly carrying weapons, is unconstitutional and would pose great harm to the law enforcement community and the public.
According to Kidd's order granting injunctive relief, no case law exists giving a person an absolute right to openly carry a weapon. Kidd says the language in the Second Amendment, “to keep and bear arms” does not mean a person is allowed to walk the streets, under any circumstances, carrying guns.
